This Privacy Notice explains how I collect and use your personal information when you visit my website, contact me through the general enquiry form, join my mailing list, or buy and use my digital products through my website. My digital products are the Nourish My Fertility Meal Builder and the Nourish My Fertility Portion Size Guide. It accompanies my Terms and Conditions. How I use cookies and similar technologies is explained in the 'Cookies and similar technologies' section of this notice.

I am based in the Republic of Ireland, and I handle your personal information in line with the EU General Data Protection Regulation (GDPR), the Irish Data Protection Act 2018, and Irish electronic privacy rules (the European Communities (Electronic Communications Networks and Services) (Privacy and Electronic Communications) Regulations 2011, S.I. No. 336 of 2011) for electronic marketing and for storing or accessing information on your device.

1.    Who I am and how to contact me
I am Jemma Henry, a sole trader trading as Nourish My Fertility. I am a CORU-registered dietitian (CORU registration number DI017675) and a member of the Irish Nutrition and Dietetic Institute (INDI).

I am the data controller for the personal information described in this notice. That means I am responsible for deciding how and why your personal information is collected and used.

2.    What this notice covers
This notice covers the personal information I process when you buy and use my digital products through my website:
the Nourish My Fertility Meal Builder, an educational, AI-powered tool that you access through your own ChatGPT account; and the Nourish My Fertility Portion Size Guide, a downloadable PDF.

It also covers the general enquiry form on my website and my mailing list, where you choose to subscribe. It does not cover clinical dietetic services.

3.    What personal information I collect
When you buy and use my digital products, I may collect:
your name and contact details (such as email address, telephone number and postal address);
order and payment information, meaning the records needed to take and process your order and payment;
digital-product fulfilment and download information, meaning the records needed to provide your download or access instructions;
mailing-list preferences, if you choose to opt in; and
website and online-shop activity, including shopping-basket information.

If you contact me through the general enquiry form on my website, I collect your first name, last name, email address and phone number, together with the information you include in your message.

I do not ask you to provide clinical records, medical information or details about your fertility through the Wix purchase process. However, the fact that you purchase a fertility-related product may itself reveal or suggest an interest in fertility. I treat your order information confidentially and use it only as described in this notice.

Please do not use the general enquiry form to send medical records, test results, or detailed health or fertility information. The general enquiry form is for general queries about my digital products and website; it is not intended for clinical information. My clinical dietetic services are covered by a separate privacy notice and are not dealt with in this notice.

4.    Why I use your information and my lawful bases
I use your personal information only where I have a lawful basis to do so under Article 6 of the GDPR. The purposes and bases for my digital products are set out below.
Processing and fulfilling your order, and providing your download or access, to perform my contract with you for the product you buy (Article 6(1)(b)).

Keeping accounting, tax and other business records, to comply with my legal obligations, including Irish accounting and tax record-keeping requirements (Article 6(1)(c)).
Sending marketing emails, and using any optional analytics or cookies and similar technologies as described in the 'Cookies and similar technologies' section, on the basis of your consent (Article 6(1)(a)), consistent with Irish electronic privacy rules.

Keeping my website and business secure, responding to and following up on your enquiries (including enquiries you send through the general enquiry form on my website), and running and developing my business, in my legitimate interests in protecting my business, customers and systems, in communicating with people who contact my business, and in running and developing my business (Article 6(1)(f)).

5.    Buying and receiving the products
You order my products through my Wix website checkout. When you buy, I process the information needed to take your order, take payment, and provide your download or access instructions.

After you buy, your download is delivered in two ways: a link shown on the Wix "Thank You" page displayed after checkout, and a separate download email containing the link. The emailed download link stays active for 30 days, and I can send you a fresh link if you need one. Where payment is delayed, for example a manual or offline payment, the download is issued once your payment is marked as received.

Where you buy the Meal Builder, the download is the Access and Instructions PDF, which contains the link to reach the Meal Builder through ChatGPT. Where you buy the Portion Size Guide, the download is a separate PDF.

Meal Builder access ends on 11 December 2026. Please save or print any meal plans you want to keep before that date, because you will not be able to access them through the Meal Builder afterwards. This access deadline does not automatically delete your purchase or order records.

Using the Meal Builder through ChatGPT and OpenAI's role
You access and use the Meal Builder through your own ChatGPT account. Under the current arrangement, I do not receive your individual ChatGPT conversations or generated meal plans, and I cannot see whether you have opened the tool or generated a plan.

Anything you enter into your own ChatGPT account is processed by OpenAI under OpenAI's own terms and privacy policy. For that information, OpenAI acts as an independent controller rather than as my processor, and its handling of your information is governed by its own arrangements with you, not by this notice.

As a precaution, please do not enter identifiable medical records, test results or unnecessary sensitive information into ChatGPT. This is a safety note for your protection; it does not mean that I collect or process health information through my digital products.

6.    Website shopping offers (AppSell)
My website and online shop operate through Wix. I use AppSell, a service provided by Importify Ltd, to show relevant upsell and cross-sell offers in my shop. To provide these features, AppSell processes certain website, shopping-basket and order information.

For AppSell, I am the data controller and Importify Ltd acts as my data processor; this is confirmed by the AppSell Data Processing Agreement. AppSell is not designed for special-category data and must not be used for it, so I do not use it to process clinical records or medical information, and I do not use it to process any special-category health data.

AppSell uses your browser's local storage and session storage (rather than cookies) to make these offers work. These browser-storage technologies, and how to manage your choices, are explained in the 'Cookies and similar technologies' section below.

7.    Cookies and similar technologies
My website and online shop are provided through Wix and use cookies and similar browser technologies to operate the site, to support the online shop and shopping features and, where you allow it, to measure activity and support marketing. A Usercentrics consent banner (headed "Privacy Settings" and powered by Usercentrics) manages your choices. The banner groups these technologies into four categories: Essential, Functional, Analytical, and Marketing.
This section applies to everyone who visits my website, including people who browse without buying a product. It is not limited to customers or purchasers.

Essential (strictly necessary) technologies are used to run the website and shop and do not require your consent. Functional, Analytical and Marketing technologies are optional and are used only with your consent, given through the Usercentrics banner, consistent with Irish electronic privacy rules. On the banner you can choose "Accept All", "Deny", or "Save Settings" to allow or reject each optional category on its own, and you can use the banner's settings to change or withdraw your consent at any time with effect for the future. Separately from these four consent-managed categories, the AppSell operational local-storage and session-storage items described below (those supporting the basket, offers and discounts carried to checkout) are set regardless of your consent choice.

You can review the cookies and similar technologies listed in the website's consent settings and change your choices at any time by clicking the cookie icon in the bottom-left corner of any page. Further information about AppSell's local and session storage, including how long it is kept, is provided below.

AppSell, a service provided by Importify Ltd, uses your browser's local storage and session storage (rather than cookies) to provide shopping-basket, upsell, cross-sell and discount features in my shop. AppSell uses an identifier called "appsell_track" to measure usage. This identifier follows the Analytical (Analytics) consent category: it is stored for about 30 days only where you allow Analytics through the Usercentrics banner. If you have not made a choice, or you select "Deny", the appsell_track identifier is not stored or read on your device; the page view is added only to a single store-wide total, which contains no visitor identifier.

AppSell's other local-storage and session-storage items (those whose names begin with "upsale_" or "appsell_") support the basket, offers and discounts carried to checkout. AppSell has confirmed that these operational items are set by AppSell regardless of your consent choice, and that there is no option to disable or delay them separately while AppSell is installed. Some of these items are kept in session storage and are removed when you close the browser tab; others are kept in local storage until AppSell removes them or you clear your browser storage. Separately from browser storage, AppSell also keeps short-term server access logs for about 30 days for security and operational purposes.Version 2Last updated: 29 October 2026The consent banner lists a Meta (Facebook) Pixel in the Marketing category. A Meta Pixel is a marketing and advertising technology provided by Meta Platforms. Where a Meta Pixel is active and you have given Marketing consent through the Usercentrics banner, it would share information about your interaction with my website with Meta Platforms for advertising and measurement purposes. You can decline, or withdraw, your Marketing consent at any time through the banner and its settings.

You can manage your choices at any time through the website's cookie banner and settings, where you can accept or reject optional cookies and similar technologies and change your preferences. You can also clear cookies and browser storage through your own browser settings.
8.    Marketing emails
If you choose to subscribe, I may send you fertility nutrition information, educational resources, business updates and occasional information about my products.
Marketing emails are sent on the basis of your consent. I use a separate, un-ticked opt-in box, and signing up for marketing is never a condition of buying a product. You can unsubscribe at any time using the link in any marketing email, or by contacting me. This is consistent with Irish electronic privacy rules.
9.    Who I share your information with
To run my digital-products business, I use trusted service providers. Depending on the service, these include:
Wix, which provides my website, online shop, checkout, digital downloads and mailing-list forms. Purchase, order management and digital-product delivery take place through Wix. I am the controller of the customer information collected through the website, and Wix processes that information on my behalf as my processor under its Data Processing Agreement.
AppSell (Importify Ltd), which provides upsell and cross-sell shopping offers. For this service I am the controller and Importify Ltd is my processor, as confirmed by the AppSell Data Processing Agreement.

Meta Platforms. The consent banner lists a Meta (Facebook) Pixel in the Marketing category. Where a Meta Pixel is active and you have given Marketing consent through the website's consent banner, information about your interaction with my website may be shared with Meta Platforms for advertising and measurement purposes. This is explained further in the 'Cookies and similar technologies' section, and you can decline or withdraw this consent through the banner at any time.

Card payments made through the Wix checkout are handled through Wix Payments. Wix and the payment processors, acquiring banks and payment networks involved process the payment information needed to complete the transaction and meet their legal, regulatory, security and fraud-prevention obligations.

I only share your information where it is necessary for these purposes, and subject to appropriate safeguards. I do not sell your personal information.

If you use the Meal Builder, you interact separately with ChatGPT, provided by OpenAI. Information you enter into ChatGPT is handled under OpenAI's own terms and privacy policy, with OpenAI acting as an independent controller for that information.

10.    International transfers
Some of my service providers may process personal information outside the European Economic Area (EEA). Where that happens, I rely on appropriate safeguards required by the GDPR where applicable, including an applicable European Commission adequacy decision or Standard Contractual Clauses.
For AppSell, Importify Ltd is established in Israel, which the European Commission recognises as providing an adequate level of protection. Where AppSell's data is hosted in the United States, those transfers rely on the subprocessor's certification under the EU-US Data Privacy Framework or on the European Commission's Standard Contractual Clauses. This reflects the AppSell Data Processing Agreement.

11.    How long I keep your information
I keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet applicable legal obligations.

Accounting and tax records are kept for the periods required by law, generally six years under Irish tax record-keeping rules, subject to any applicable exceptions.
In particular, I apply the following retention periods:

Order, invoice, payment and tax records: six years, or longer where required because of an ongoing Revenue inquiry, dispute or other legal obligation.

General customer-support correspondence: two years after the query is closed. Messages you send through the general enquiry form are treated as general customer-support

correspondence and kept on this basis; if the correspondence concerns a complaint, refund, dispute or legal claim, it may be retained with the relevant order record for up to six years.
Marketing information: until consent is withdrawn or the person unsubscribes; a minimal suppression record may be retained after unsubscribing to ensure the person is not contacted again.

Other website, basket and browser-storage information: for the period described in the 'Cookies and similar technologies' section and in the applicable Wix and AppSell information.

12.    Your rights
Depending on the circumstances, you have the right to:
access the personal information I hold about you;
ask me to correct inaccurate or incomplete information;
ask me to erase your information;
ask me to restrict how I use your information;
object to my use of your information;
ask for your information to be provided in a portable format;
withdraw your consent at any time, where I rely on consent (this does not affect anything done before you withdrew it); and
lodge a complaint with the Data Protection Commission (DPC), the Irish supervisory authority.
Some of these rights are subject to legal conditions and exceptions, and they may not apply in every situation. To exercise any of your rights, please email me at jemmahenry@nourishmyfertility.ie.
